My husband as filled out his applicant app. for outside canada.

When he tried to cross the border awhile ago he was refused because they told him he had dui's on his record. He told them he had no idea what they were however 30 years ago he was a huge drinker and doesn't recall alot of things.

They told him to get a Police Clearance from his State and return and they would allow him in. He went back to Illinois got Police Clearand and FBI done and both are clear with no convictions.

Now when he does is applicant app. it asks "Have you ever been detained" even though he doesn't really recall 30 years ago does he put down "yes" because of what the border immigration says with a attached letter indicating he doesn't remember the dates and is going by what the border told him when he tried to enter Canada.

If he puts down "No" and there really is something on their computer then it looks like he is lieing.

I have downloaded the application for FOSS NOTES. Do we send this in with the application so we have a clearer picture on what they are looking at.

On the Foss Notes app it ask for Client # what number is that he doesn't have a client # right now.

We want to do this correctly so please give us as much information as you can.

If you're talking about the question on IMM0008/Schedule I "Have you ever been refused admission to, or ordered to leave, Canada or any other country?", then, yes, he will need to answer "Yes" - he was refused admission to Canada that one time. But lots of people are refused admission to Canada - don't make it a bigger deal than it is. They said they found a criminal record for him in the computer - but that turned out to be a bunch of bull, right? He has since obtained clean FBI and State criminal clearances. So he can explain that on whatever date that was, he was refused entry to Canada - period. As I mentioned to you by email - the more you guys make this an issue, the better the chance that they'll make it an issue. Don't give them reason. Going into all the details about how someone at the border accused him of having a criminal record might just make them delay your processing indefinitely while they try to dig one up - in spite of the fact that there isn't one to find, and he has clearances to prove it. I suspect the real issue was that he had tools in his truck, and they didn't believe he wasn't coming to Canada to work and, even though he had a reasonable explanation for that, they didn't want to let him in and simply found a more "intimidating" reason for refusing him entry . . . true or not.

Seriously - forget it happened. I know it was traumatic - I went through something similiar - but stuff like that happens every day. Don't give them ammunition to continue making your life miserable with it. The accusations were unfounded - don't bring them back into focus with your application just because you're worried that he can't remember things he did as an alcoholic 30+ years ago. The criminal clearances are what they look at to verify that he has not had any convictions . . . don't give them reason to go searching for a reason to find him inadmissible.

As far as the FOSS notes and the client ID# - was he given a status document when he finally entered Canada, or is he just here with a stamp in his passport or waived through? If he has a status document (like a visitor record), it has a client ID# on it. Otherwise, he doesn't have one, so leave that blank. And, no, you don't send the application for FOSS notes with the PR application. It goes separately to another address. The instructions on how to apply for FOSS or CAIPS notes (which would be info on the outland PR application once it's in process in Buffalo) are at this Immipedia link.

The question is on Declaration/Background #0008 and it says "Have you ever been detained or in jail"

That was where we didn't know what to put so we are now going to put no. I guess even if we put yes....like you said they will start looking for something to keep him out.

I believe what they told him is bull but they tend to scare you and make you feel uneasy.

He was just waived through the next time he came through no stamp on his passport or anything.

When do I ask for an extension on his stay.....cosidering they didn't stamp anything do they know when he came across or do they depend on you telling them that.

I am sure I will other question and honestly I don't know how I would have done all this without you.
