Full Version: Tricky situation with timing

I had successfully sponsored my wife recently. The visa she was given is valid until October 2010 (2 months left). We thought we had enough time to wrap things up but it is very apparent now that we don't have time to sell our house and deal with schooling for our kids.

Currently, my wife is a Green Card holder. We are trying to figure a way for her to enter Canada and get her landed status and returning to the U.S to wrap things up. However, what we are afraid of is U.S immigration taking away her Green Card upon learning that she had been granted permanent residency in Canada. We are trying to avoid going through the visa process in order for her to return to the U.S. What if her visa request is rejected? Not a good option! Our plan is to reside in Canada permanently but we need at least 6 more months to settle our affairs.

The Canadian consulate had made it very clear to us that the visa time would not be extended.

My wife has a Travel Document issued by the U.S.

Any ideas about what we can do in this situation?

She can land & return the same day, there's nothing stopping her from doing that.
I don't know about the logistics of being a GD & PR holder, but I know people do it all the time. The problem (down the road) comes from people trying to maintain both.
They are not going to yank her GC @ the border because she's landed as a PR.
So, have her land, she'll need to give a CDN address for them to mail her PR card to (they won't send it outside of Canada). If she doesn't have anywhere it can be sent, then she can apply for it once you folks are back in Canada.
The PR visa will not be extended, she MUST land before the expiry date. I would highly suggest you not wait until the last possible minute either. Inevitably when you have like "1" day left to do something, the forces conspire against you.

So...not sure where you are located in the States but - get her to a border, have her land and go do what needs to be done to wrap things up. Come back and enjoy.

I have a follow-up question:
How can she enter Canada and return the same day to the U.S? Would not U.S immigration see that her Travel Document has been stamped with Canadian PR and potentially cancel her Green Card? I believe one can no longer enter the U.S using only a Green Card. I am trying to understand how this works.

Where is she from originally?
She is from Africa originally. She obtained her Green Card as an asylee.
