I have been a guest here for a while and have decided to jump in and finally become a part of the Road to Canada family.Grouphug I recently did my FBI and state clearances and they both came back with no record. Yippee, but all is not so cut and dried, in 1982 I was arrested for shoplifting, there is a story that goes with this, isn't there always? I will spare you the details. Anyway I went to court paid a fine and that was that, the record was expunged and I moved on with my life.

I do not want to lie on the immi app, as all my family members have suggested I should. I am a worrier, and having to wait while CIC decides my fate would probably put me in the hospital. I no longer have the expunged paperwork as my mother destroyed them years ago. I have sent away to the state for a certificate of expungement, and I am planning to have a lawyer write a letter explaining expungements in Florida. There is a long list of what can and cannot be expunged and my file was automatically expunged by the state, and expungement files show no record as they are "destroyed.

Do you guys think that should be enough or should I also do a request from the city where all this took place, it will also show no record, and should have also have a lawyer in Canada write a letter explainig deemed rehabilitation? I want to make sure I give them as much as possible.

Thanks for your reply. I was 19. So you are saying just provide the certificate of expungement along with my explanation of what happened and move on? I have read where they want depositions and the like. I am just trying to get all my ducks in a row before I submit my paperwork.
I wouldn't even mention it on your application if it's not on your police checks

I wouldn't either.
I agree - don't borrow trouble. If it's not on your clearances, leave it in the past. That's what "expunged" means.
Wow, ok then. My mom, my sister and I have been going back and forth on this, not only are they totally over me Sigh, they agree with you guys. My mom said to me "you know what it's not on the police records, please stop acting like you killed someone and move on and get your paperwork finished." I guess I will do that.

Derbygirl, After reading Bunny's posts, Do you think I should still not mention about my arrest?

I did say I am a worrier. It has served me well in my career, ability to see the big picture is the positive spin..
I would definitely not mention it - as others mentioned, you're inviting trouble
Expunged means that you can legally answer "no" to those questions
At least that's always been my understanding of expunged
We have a few attorneys here who could probably expand on that though

Bunny's husbands situation is also quite a bit different than yours
