Full Version: Hello again.....need some urgent help

Outland Spousal App sent Mississauga.......sent to Buffalo..........Buffalo requested Arrest Records and court dispositions whether convicted or not........

My husband went to Chicago to gather all records because you can ONLY view arrest records in Illinois you can't send for them and you can't get copies you can only write down the info and then get the dispositions from the courts.

The records show old arrest records of early 1980's of driving without a licence.......no convictions. He has all the paperwork now notaraized from the courts, police clearances etc.

When he came back through the border they gave him a 2 week stay only and he has to return to U.S. I have no idea why but anyway that is what were faced with.

My question is:

Can we submit a extension to stay or remain in Canada my understanding as long as the paperwork is sent in you can remain until decision is made on the extension is that correct. By the time that is done all the proper paperwork will be in the hands of Buffalo for a decision.

We want to do things the right way. But this throws a wrench into everything.

1. Yes you can submit an extension request and have implied status until the decision.
2. I really don't think that your spouse got what CIC is requesting. Usually they would ask for a criminal records check from Illinois. (fingerprint one) It can be done by mail. http://www.isp.state.il.us/crimhistory/c...ryhome.cfm The dispositions should show up on the results.

I am pretty sure (99.99%) you can apply for an extention and you will have implied status until they say yes or no. But you MUST apply before his status expires, send it to Vergreville with FEDEX or something fast and proof of delivery.

I know CIC keeps changing the goal posts on state checks, but I just thought I'd mention that my husband got the non-fingerprint check from Illinois and had no problems. This was over 2 years ago, though.
I think they already submitted police checks from Illinois
I think because of previous problems they (CIC) are now asking for more information

Bunny, I think if you can get them (Illinois) to give you something saying that they don't do that - I think that's the best you can do really

We got everything they want just waiting for another police clearance from illinois.....the last one we sent in was on a plain piece of paper looking so unofficial we are hoping they send one this time with a seal on it. We got one from Rhode Island and it has a proper seal on it and looks veryv professional.

I just hope they give him a extension to his stay so he doesn't have to go back in 2 weeks. He didn't have our marriage cert. when he came across he had everything else but they again treated him like a criminal.

All his clearances are clean except for a few driving without a licence and taillights out and minor stuff. And these date back to 81 & 82.

Guess I will send for caips and foss notes.

That's what our clearance from Illinois looked like. If I recall correctly, you have to request the form for requesting the "certificate", and it comes with a serial number on it. You fill it out, send it back to them, and they send it back either stamped no record or.... well, I don't know what it looks like if there is a record. Regardless, ours didn't have a seal on it. CIC accepted it, no problems.

Too Bad, CIC has flip flopped again, stating that you don't require state certificates unless requested. Posted 15/10/09.
