We received your application for permanent residence on January 21, 2008.

We started processing your application on February 25, 2008.

Medical results have been received.

A decision has been made and you will be contacted.

Received AIP on June 29 and Foss with a request for info a few days later.

I received my letter for AIP and a few days later my FOSS notes. All of it looks clear except they want me to send in my State police certificate. Their issue is my FBI comes up clean and before I knew how to obtain state I got my records from my local police dept. Well anyways Local says I have a record and FBI is clear so they need State. I would be about done right now if I just had what I needed way back. So now I wait for the State record. Letter says nothing else will be done until they get it.
You had some weirdo local deal if I remember correctly?
Get the state and if there is ANYTHING on it - I'd say get something from the court saying it's been resolved.

Yea probs with hillbilly courts and cops. Hopefully state comes up clean. I did also think about writing to ask for some form of forgiveness for the DUI or w/e they ended up charging me with. It is funny though because even when I got auto insurance no DUI ever came up and I know they ran me because they told me that my driving record came up clean. Weird. I did have to pay a reinstatement fee when I got my license back but when I did go to the license buruea they said my record was clean. Who knows I'll find out soon I guess.
Okay - I looked back to see what the deal was.
What I'd do is - get a state police check.
I believe you were from Ohio - in this thread is the information for Ohio.

I probably would have done that rather than gone with the messed up local people. But - anyways - what's done is done now.

CIC is now aware of a potential problem. I'd beat feet & get a state clearance from Ohio. If THAT shows clean - I think I'd try getting any & everything from the courts showing the case. I included a letter/certificate of disposition from the courts where my case was processed.

Maybe you had something like a "minor in possession" or something (being as that you were 18 & under the legal drinking age).
I know that in NY - a MIP will lose their driver's license for anything over .02%.

But - that's how I'd proceed - the best defence is a good offence. See what the state & DMV has to say. As far as DMV saying your record is clean - well after this long it would be - things don't stay on your license forever.
I was surprised to read this because I may be in a similar situation.

I am from Ohio, in 2004 I got a dui...I hadn't been drinking alcohol but was a bit "tipsy" from cough medicine (I took a bit over the recommended dose bc I felt terrible :P ), anyway they charged me with the dui but the court made a deal with me. I had to pay them $450 (or around there, can't remember the exact amount) and go to a divergence program, and they would clear my record.

I have not gotten my state record check yet, but I'm crossing my fingers that it will be clear like they said it would be.

I have the original court document stating my license suspension was removed and an attached page that states the officer did not have reason to detain me.

Do you think I should include all that in my PR app? I did with my VR app and I got the VR just fine...just curious :)

Oh, and yell at me if I should have posted this somewhere else, I just thought it had to do with the same subject, same state... /shrug :)
Lol...I don't mind if you posted in here. Thats what all this is for, to help everyone compare and get help and support while going through all of this.

In my eyes anything that shows to be positive would be good. I wouldn't send it in with the app if it may look bad on your part and it is not requested.

I hope maybe DerbyGirl or someone might have some input on this. I am new to all of this. I have been reading for some time now but seems there are some more experienced people on here.

I wish you luck on that because I know exactly how it is.

What I would do (and this is just me) - I would get your FBI clearance and any state clearances you need.
Then - see what they say. Even though it sounds like you got something like an ACD (adjournment in contemplation of dismissal) - which is - pay your fine, stay out of trouble for a certain time frame (6-12 months usually) and maybe go to some traffic school - it will usually be on your police checks. (as sealed, or such)

Once you have those & see what they say - proceed as above with getting any & everything from the courts detailing the case & that it's been resolved.

FYI - even though you weren't drinking, being under the influence of medications (prescribed or OTC) can still lead to an impaired charge.
Something along the lines of DUI (driving under the influence of alcohol or drugs). People sometimes forget what OTC medications can do to a person.

You will have to explain this to CIC also (the situation - what happened, etc)

I had a few old things that were ACD'd - and they still appeared on my state check & basically said something like "record sealed". This would not appear to say - an employer who did a record check - but because it was me requesting a record check - it showed up.

I think this might be one reason that CIC has us submit them rather than submitting say a release for them to get it. (just a guess - I really do not know)
Thanks guys :) I think I will contact the court in Ohio and see if they can send me anything detailing the case.

From what I've read in the guide from CIC...convictions matter but not charges correct? And I was never really convicted was I? I really don't understand the whole thing as you can tell.

Also I tried calling BCI&I in Ohio and the phone number from that thread and on the website you linked is disconnected now. Here is a link with a new number just incase someone needs it.

Ah and also, I forgot to ask...what exactly would a "waiver of release" look like? :) I called to ask but then realized I'm on the west coast now and they've been closed for 2 and half hours.
Hey Wizdumb1, I am sure your are aware, but still reminding you of one important thing is that CIC-V would have assiged a Bring Forward (BF) date to your file which in most cases is three months. So you have to submit whatever they want before that. Please call CIC or check your FOSS notes and see what that date is.
[FONT=Arial, Verdana, Helvetica]Well I am still at a stand still....:( I did find out today that my state police record request is on its way in the mail and should be hitting my box any day now. It's the only thing holding back my application right now.

Another thing...I braved it and went on the Alaskan cruise last week for 7 days. It turned out great and had a great time. The guy at the border looked at our passports asked me when the last time I entered was which was Oct. 2007 and that was it we made it though with no more questions and I was approved for another 6month visitor status which is good because I had no good status before we left. I know now if it takes longer I will have to renew my status on time so it does not happen again. Plus The school board helped me here and I was able to register my child for school!! I'm filling out my work permit now because it looks like it may take a little time now with all the delay with my police certificate. In all I guess I'm still in for a little wait and hopefully all turns out ok. I haven't been on in a bit so I just wanted to say Congrats to all those who have made it!!!!!

DerbyGirl had it right: get the FBI and State cert and see what they say. If it isn't there, if they show clear/clean, you are good to go.
If something is there, go back to the rest of what DerbyGirl said.

wizdumb1 -- well, despite the delay, your app seems to be on a timely schedule compared to a lot of others going the in-Canada route. And the successful exit and re-entry seems to deserve a hearty congrats!

Now that you have status again, if you're filing inland, be sure you submit that work permit application WITH your PR application - that way you'll automatically be issued an open work permit as soon as you reach first stage approval (AIP) . . . which, hopefully, will be in 4-5 months. That also gives you implied status until they make a decision on AIP - in case there's a hold-up because of the arrest issue. At least your visitor status will stay valid - even though the work permit would be delayed.
I have already reached First stage approval about 2 months ago. Got my state record in the mail today and it says I have no record...Lmao
Wonder if sending that local police record will cause me any more head aches.
FBI and State record checks are both clean. Faxing it off today hope thats all they need now I'd love to get though this.
Don't bother faxing them - they want originals.
