Hi All,

I arrived in Canada with my 3 year old daughter on November 12 with a Visitors Visa (entering from the UK), our temporary resident visa will be up on 12th May and we want to extend to stay here with my boyfriend, until we get married and then apply for permanent residents.

We have the form for extension already, stored on the computer, but I am unsure how to fill it out. Do I be honest and say what our intentions are, or do we fib a little and say we just want to extend our visit with Family and Friends....im not sure what the best road forward is, I just dont want us to have to go home in may.

and if we say we are just visiting how do I prove I have the funds if I dont have a bank account in canada..., how do you prove you have family and friends and will go home if you have to.

Im just looking for some advice, anyone elses stories if they have been in the same boat.

Thanks

What you've said above is exactly the point - how will you prove you have funds to support yourself, or that you will go home, and not if you have to - because (right now in your situation) you really do have to. Unfortunately, wanting to stay in Canada for long enough to facilitate a wedding after you''ve already been here for six months probably won't fly. And until you are in a relationship that qualifies you to be sponsored for permanent status (marriage), you really don't have to "right" to stay any longer than six months. You won't even be able to "use" him to prove you're being supported here and you won't work illegally to support yourself and your child.

My suggestion: if you don't want to be separated and you're going to get married anyway, do it before May 12th . . . even if you just get legally married and have a wedding later. You can send the extension application to CPC-Vegreville by courier after the marriage, and as long as it's received by them before the expiration of your current status, you'll have "implied status" to remain in Canada until they make a decision on the extension. You'd want to send a copy of proof of your marriage, and proof that he is applying to sponsor you for PR (usually a copy of your receipt for payment of the application fees - $75 sponsor, $475 applicant and $150 for your daughter - is sufficient proof). You'll always want to provide proof of his funds to support you, then, by submitting a copy of his T4 or paystubs.

Otherwise, you're best to leave by May 12th, and then just return when you're ready to get married, if you're going to get married in Canada (although you'd never say at the P.O.E. that you're coming into Canada to marry).
